This Distance Sales Agreement (“Agreement”) is entered into electronically between the parties whose details are provided below, in accordance with the provisions of Law No. 6502 on the Protection of Consumers, the Regulation on Distance Contracts, and other applicable legislation.

2. SUBJECT OF THE AGREEMENT

The subject of this Agreement is to determine the rights and obligations of the parties with respect to the sale and delivery of products ordered electronically by the Buyer through the Seller’s website www.dekolte.com.tr, whose specifications and sales prices are indicated.

3. PRODUCT INFORMATION

The type, model, quantity, size, color, unit price, total price, payment method, and shipping details of the ordered products are stated in the order form confirmed by the Buyer and in the preliminary information form sent via e-mail.

For evening gowns, the Seller attaches a “Dekolte Ribbon” security tag to each product to ensure hygiene and quality. If this ribbon is removed, detached, or damaged, the product is considered “used.”

4. FORMATION OF THE AGREEMENT

The Buyer declares that they have read and understood this Agreement before confirming their order.

The Agreement enters into force once it is approved electronically and becomes binding on both parties.

5. DELIVERY CONDITIONS

Products are delivered to the delivery address provided by the Buyer at the time of order, via contracted shipping companies.

Under normal circumstances, orders are delivered within 30 days from payment confirmation. In case of force majeure (natural disasters, pandemics, transportation restrictions, etc.), the Seller may extend the delivery time, and the Buyer will be informed accordingly.

At the time of delivery, the identity of the Buyer or the person authorized to receive the order may be verified.

6. PAYMENT CONDITIONS

The product price is collected through the payment method selected at the time of order (credit card, bank transfer, cash on delivery, etc.).

Before confirming the order, the Buyer is informed of all applicable taxes, shipping fees, and the total order amount.

7. RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw from the order within 14 days from the date of delivery without providing any justification.

The right of withdrawal does not apply in the following cases:

• If the product has been used, washed, or altered,

• If the Dekolte Ribbon security tag has been removed or damaged,

• For custom-made, altered, or hygiene-related non-returnable products.

Withdrawal requests must be submitted in writing to [email protected].

In the event of withdrawal, the return shipping cost belongs to the Buyer, unless the product is defective or incorrect.

8. RETURNS AND REFUNDS

Once the return request is approved, the product must be sent back to the Seller together with its invoice.

Upon arrival at the warehouse, the product will undergo quality control. If the ribbon and product are deemed suitable, the refund process will begin.

The refund will be made to the Buyer’s account within 10 business days, depending on the payment method used.

9. PROTECTION OF PERSONAL DATA

The Seller processes and protects the Buyer’s personal data in compliance with Law No. 6698 on the Protection of Personal Data (KVKK) and related legislation.

Personal data will not be shared with third parties, except for completing the order and delivery processes.

10. DISPUTES

In the event of disputes arising from this Agreement, the Consumer Arbitration Committees and Consumer Courts located at the Buyer’s place of residence or where the purchase was made shall have jurisdiction.

11. ENFORCEMENT

By confirming the order, the Buyer declares that they have read, understood, and accepted all the provisions of this Agreement.
